And in many cases, you don't have to do a single thing to find out.

What Is the Rudisill Decision — and Why Does It Matter?

Back in 2024, the U.S. Supreme Court issued a landmark ruling in a case known as Rudisill v. McDonough. The short version: the Court determined that certain veterans who served under multiple enlistments — and therefore earned entitlement under more than one education benefits program — should be able to use both sets of benefits, up to the aggregate cap. This was a big win that a lot of veterans didn't even know applied to them.
The VA has since identified roughly 1.04 million veterans who may be impacted by this ruling. That's a massive number — and there's a real chance you or someone you know is on that list.
What Changed in 2026: The Perkins Decision Adds Even More Coverage
More recently, the United States Court of Appeals for Veterans Claims issued another important ruling in Perkins v. Collins. This one expands eligibility even further: veterans who served for a single obligated period of service (meaning one continuous stint) could now qualify for benefits under two different education programs, depending on the length and specific dates of that service.
In other words, even if you only had one enlistment, you might still qualify for benefits under multiple programs. That's a significant expansion of who's eligible.
The Best Part: VA Is Now Doing the Legwork For You
You no longer need to submit a claim or request a review to find out where you stand. The VA announced that it is automatically reviewing the files of all 1.04 million potentially impacted veterans.
Previously, about 380,000 of those veterans had been told they needed to file a formal request to get a decision. That requirement has been dropped. The VA will now proactively review records and either issue a formal decision or let veterans know if any additional action is still needed on their end.
What this means practically:
Already applied and waiting? You should soon receive a letter via U.S. mail confirming your application is being reviewed.
Haven't applied but may be eligible? VA will review your file automatically.
Currently enrolled in school and running out of benefits? VA will review your record for potential additional entitlement under these rulings.
